Temporary Invalidation of Rule Passed at Fall 2018 House of Delegates Meeting

SUBJECT:     Temporary Invalidation of Rule Passed at Fall 2018 House of Delegates Meeting
 
Fellow Members of Michigan Swimming,
 
At its meeting on January 14, 2019, the Michigan Swimming Board of Directors received a communication from the USA Swimming Rules and Regulations Committee stating that an LSC rule adopted at Michigan Swimming’s Fall 2018 House of Delegates Meeting was in conflict with the USA Swimming Rulebook.
 
The LSC rule in question is as follows, excerpted from the minutes of Michigan Swimming’s Fall 2018 House of Delegates Meeting:

4. Modifications or additions to a Published Meet Announcement: Changes  shall  only be made  with  the  agreement  of  both  the  Meet  Referee and the  Meet  Director.
 
The communication from USA Swimming’s Rules and Regulations Committee states, in part: “…this rule or procedure is in violation of the USA Swimming rules, unless it further provides for the necessary notice under 102.7.3.”
 
As such, on January 14, 2019, the Board of Directors adopted a resolution to temporarily invalidate the LSC rule in question passed by the Michigan Swimming House of Delegates in the Fall of 2018. At its regularly-scheduled February or March meeting, the Board of Directors will exercise its powers under the “Emergency Changes” provision of the Preamble of the Michigan Swimming Rules & Procedures to bring the LSC rule in question into compliance with the USA Swimming Rulebook as outlined by the USA Swimming Rules & Regulations Committee, thus re-instituting the LSC rule and carrying out the wishes of the Michigan Swimming House of Delegates.
 
Therefore, until the Board of Directors amends the Rules & Procedures to bring the LSC rule in question into compliance with the USA Swimming Rulebook by providing the necessary notice required by 102.7.3, the aforementioned LSC rule passed by the Michigan Swimming House of Delegates in Fall 2018 stands as temporarily invalidated and is not currently in effect. All changes to Published Meet Announcements must be processed through the Meet and Sanctioning Chair as was done previously.
 
The Board wishes to reiterate that it will work diligently to bring this LSC rule into compliance with the USA Swimming Rulebook and carry out the ultimate wishes of the House of Delegates. Immediately after this happens and the LSC rule is deemed to be in compliance, the Board will send out a communicaiton notifying all members of the development.
